Discuss and consider action to approve an encroachment agreement with Century Land Holdings II, LLC & GRBK Edgewood LLC, associated with the Colorado River Raw Water Lines, and authorize the City Manager to execute the same.

Summary
Century Land Holdings II, LLC & GRBK Edgewood LLC “Corporation” is currently developing a residential subdivision along and adjacent to the City’s Colorado Raw Waterline Easement. The development (Braker Valley Subdivision) along and east of Cameron Road between Blue Goose Road and Braker Lane requires access and other detention pond drain lines encroachment within a waterline easement along the eastern side of Cameron Road. This encroachment is intended to allow access for the development permit approval through the City of Austin.

Metes and bounds descriptions for the future roadway and other are provided survey work and project design are complete. The subdivision improvements will cross the City’s raw waterline easement that conveys water from the Colorado River in east Austin to Lake Pflugerville on Weiss Lane. As the City’s waterline easement was recorded prior to Braker Valley subdivision plat, the Corporation is required to complete an encroachment agreement to allow for the encroachment and to ensure there are no conflicts in the future regarding any subdivision improvements. City staff have reviewed the encroachments and do not have any objections to the crossing as it will pose no future issues to the City’s raw waterlines that is constructed at a significant depth to minimize future issues with other utilities,

This encroachment agreement is the City’s standard encroachment agreement that has been previously approved by the City’s legal team and has been used extensively for other water and wastewater line encroachments previously approved by City Council.
