Summary
In order to effectively implement Chapter 158, the Storm Water Pollution Control Ordinance, amendments are required to the Unified Development Code as well as the Engineering Design Guidelines. The proposed amendments to the Unified Development Code include amendment to Subchapter 3 to add submittal requirements associated with Chapter 158 for a Site Development Permit application; amendment to Subchapter 5 to ensure development within the SH 45 and SH 130 Corridor District and 685 Commercial Park Overlay District comply with Chapter 158 as applicable; amendment to Subchapter 6 to provide reference to Chapter 158 when a non-conforming use or site is required to comply with the provisions of Chapter 157; amendment to Subchapter 15 to add submittal requirements associated with Chapter 158 for a Preliminary Plat and Construction Plan application; and amendment to Subchapter 16 to add reference to Chapter 158 within the Drainage Standards.
Prior City Council Action
On December 13, 2011, the City Council approved Ordinance No. 1095-11-12-13 which established Chapter 158, Storm Water Pollution Control Ordinance. A public hearing on the ordinance was conducted on March 27, 2012 as advertised. The ordinance was approved on first reading on March 27, 2012.
