Title

Approving an ordinance on second reading with the caption: AN ORDINANCE OF THE CITY OF PFLUGERVILLE, TEXAS, ANNEXING, FOR FULL PURPOSES, AN APPROXIMATELY 97.5-ACRE TRACT OF LAND SITUATED IN THE ANDREW AUSTIN 960 ACRE SURVEY NO. 19, ABSTRACT NO. 38 OF THE REAL PROPERTY RECORDS OF TRAVIS COUNTY; EXTENDING THE BOUNDARIES OF THE CITY TO INCLUDE THE LAND; AND TO BE ZONED AGRICULTURE-CONSERVATION (A); BINDING THE LAND TO ALL OF THE ACTS, ORDINANCES, RESOLUTIONS AND REGULATIONS OF THE CITY; APPROVING A SERVICE PLAN; AND PROVIDING AN EFFECTIVE DATE. (ANX1604-02)

Summary

The proposed annexation consists of one tract of land totaling approximately 97.51 acres located along Cameron Road, south of Cele Road and north of Jesse Bohls Road within the City's extraterritorial jurisdiction. The subject tract is an improved tract of land previously governed by a non-annexation development agreement, but subsequently released from such agreement in 2008. The City will be the wastewater service provider for the subject tract, while Manville is anticipated to provide water utility service.

This proposed annexation is exempt from annexation plan requirements in the Texas Local Government Code, Chapter 43.  Although the tract of land is not immediately contiguous to property within the city limits, it is surrounded on all sides by properties with non-annexation development agreements which provides for contiguousness to the area as required per state law (Sec. 43.035(c)).

Prior City Council Action

The City Council approved a resolution authorizing the annexation process on April 26, 2016. City Council conducted the first public hearing on June 14, 2016 and the second public hearing on June 28, 2016. On July 19, 2016, City Council approved the annexation on first reading.
