Discuss and consider action to approve a resolution for an Advanced Funding Agreement (AFA) with the Texas Department of Transportation (TxDOT) affiliated with the East Pflugerville Parkway and SH 130 Intersection Improvements.
Summary
As part of the 2014 GO Bond for transportation projects, East Pflugerville Parkway and SH 130 were approved by the voters for construction. A portion of the proposed improvements are located on the TxDOT facility.
TxDOT requires the execution of an Advanced Funding Agreement (AFA) for any improvements proposed onTxDOT facilities. It is a requirement of the AFA that the City Council pass a resolution adopting the AFA for the associated improvements. The AFA addresses ownership and maintenance responsibilities for the proposed improvements within TxDOT right of way.
Furthermore, the AFA requires the City to “adopt, in its totality, the State’s federally-approved Disadvantaged Business Enterprise (DBE) program” for use with this project.
Per TxDOT's requirements, following City Council approval of the resolution authorizing the AFA, City staff will forward the approved resolution and project plans to TxDOT.
The City Attorney has reviewed the AFA and has expressed concerns about the DBE program requirement.
