Title

Authorizing the City Manager to execute a First Amendment to the Right of Way License Agreement between the City of Pflugerville and the Penley Park Homeowners Association (HOA) applicable to all City streets and public parkland within the subdivision.

 

Summary

The Penley Park subdivision is along the south side of Gattis School Road between Oak Vista Drive and Links Lane. The developer entered into a right of way agreement with the City of Pflugerville in 2014 to allow the installation of landscape improvements including but not limited to plants, shrubs, trees, grasses, irrigation systems and other landscaping within portions of the City public rights of way and public parkland in Phase 1 of the Penley Park development. The proposed amendment expands the original agreement to include the two parkland lots in Phase 3 recorded in Document 201600155, allowing landscape improvements to be installed in the public parkland.  All maintenance of the landscape improvements will be the fiscal responsibility of Penley Park HOA.

 

Approval of this item authorizes the City Manager to execute the first amendment to the license agreement and subsequently record it with Travis County.  The City Attorney has reviewed this document and approved it to form.
