Discuss and consider action to authorize the City Manager to execute a Developer Participation Agreement between Continental Homes of Texas, L.P. and the City of Pflugerville for construction of parking infrastructure for the Wilbarger Park along Craters of the Moon Boulevard.
Summary
Continental Homes of Texas, L.P. is building an extension of Craters of the Moon Boulevard extension to serve the Highland Park, Phase C, Section 3 subdivision. The City’s plan for Wilbarger Creek Park proposes to widen Craters of the Moon Boulevard to provide on-street parking for the park. The City and the Developer agree that it would be in the best interest of all parties to add the City’s parking project to the developer’s street construction scope and have all the work constructed at one time.
Through this agreement, the developer agrees to include the City’s parking requirements in the developer’s street construction project. The City will reimburse the developer for the cost of the City’s added scope in an amount not to exceed $309,541. The cost was developed from contractor’s unit prices for the construction of Craters of the Moon.
Status
The agreement has been reviewed by the City Attorney. The developer is prepared to start construction upon total execution of the agreement.

Fiscal Impact
Infrastructure improvements cost are a not to exceed amount of $309,541 and is funded by the 2014 General Obligation Bond Program.
