Title

Approving an ordinance on second reading with the caption reading: AN ORDINANCE OF THE CITY OF PFLUGERVILLE READOPTING CODE OF ORDINANCES TITLE IX GENERAL REGULATIONS, CHAPTER 95 PARKS AND RECREATION SUBCHAPTER 95.50 YOUTH PROGRAMS STANDARDS OF CARE; REPLACING ALL ORDINANCES IN CONFLICT; CONTAINING A SAVINGS CLAUSE AND DECLARING AN EFFECTIVE DATE.

 

Summary

The Texas Human Resources Code Section 42.041 (b) (14) provides an exemption to child care licensure requirements for an elementary-age recreation program operated by a municipality provided that the governing body of the municipality annually adopts standards of care by ordinance after a public hearing for the program.  This ordinance has been provided to establish these standards of care in order to exempt Pflugerville Parks and Recreation programs from state child care licensing requirements. These standards of care are intended to be minimum standards by which the City will operate its Parks and Recreation Department summer camp and other programs.  Pflugerville Parks and Recreation programs are recreational in nature and are not child care programs. 

 

This ordinance was approved as written by the City Council last year.  No changes to the ordinance are recommended at this time.  The ordinance has been approved as to form by the City Attorney. 

 

A public hearing and re-approval of the ordinance is required each year. 

 

Previous City Council Action

A public hearing was held and the City Council approved the ordinance on first reading on April 25, 2017.

 

Staff Recommendation

Approve the ordinance on second and final reading.
