Title

Approving an ordinance on second reading with the caption reading: AN ORDINANCE OF THE CITY OF PFLUGERVILLE TEXAS CLOSING,VACATING, ABANDONING AND CONVEYING A PORTION OF BECKER FARM ROAD IN THE CITY OF PFLUGERVILLE, TEXAS; AUTHORIZING THE CITY MANAGER TO EXECUTE A DEED WITHOUT WARRANTY; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE; REPEALING ALL ORDINANCES TO THE EXTENT THEY ARE IN CONFLICT; PROVIDING FOR SEVERABILITY; AND DECLARING AN EFFECTIVE DATE

Summary

This ordinance will partially vacate an existing, unpaved, portion of the right-of-way at the north end of Becker Farm Road that was never used as a public road.  The right-of-way was originally part of the parent tract immediately adjacent on the west.  Vacation of the right-of-way will allow development of the property and will remove maintenance responsibility from the City.  City staff has confirmed with all franchised public utility providers and appropriate City departments that the property is no longer needed or that easements will be provided and that it is in the public interest to close, vacate, abandon and convey the property to the requestor.  The City Attorney has reviewed and approved the abandonment instrument as to form.

Previous City Council Action:

This ordinance was approved on first reading on November 28, 2017.

Staff Recommendation

Approve the ordinance on second and final reading.
