Approving a resolution clarifying extraterritorial jurisdiction status for property subject to a non-annexation development agreement on Cele Road.
Summary
In 2016 the City entered into a Non-Annexation Development Agreement with 7B Farm LLC for their property located on the north side of Cele Road just east of Cele Middle School that consists of approximately 151.8 acres. This agreement stated that the City would not annex the property until such time the property owner decided to develop the property as long as the property was utilized for agriculture, wildlife management, or timber. Development of the property would constitute a petition for annexation. At this time, the property owner and the City are considering inclusion of this property into the Lakeside MUD consent agreement (see related item RES-0479). The approval of this resolution authorizes the City Manager to execute the agreement (Exhibit B) with the property to provide assurance to the property owner that the consideration to include this property within the Lakeside MUD does not constitute development and therefore would not trigger the requirements for annexation as provided for within the Non-Annexation Development Agreement; and, the property will remain in the city's extraterritorial jurisdiction.
