Title

Approving a resolution authorizing the City Manager to execute a Termination of Restrictive Covenant Instrument to terminate an existing drainage easement within the Carmen subdivision.

 

Summary

This resolution authorizes the City Manager to execute a Termination of Restrictive Covenant Instrument to terminate an existing restrictive covenant with the four landowners within the Carmen subdivision.  The original restrictive covenant was put in place in 2008 by Travis County for the construction of Wells Branch Parkway and Heatherwilde Boulevard and the associated drainage along the extents of both streets.  Land owners in the vicinity are working to terminate the original restrictive covenants granted to Travis County for drainage purposes and replace them with drainage easements granted to the respective cities, Pflugerville and Austin.  The proposed covenant termination in the City of Pflugerville has already been replaced with drainage easements in the same location.  The City Attorney has reviewed and approved the termination instrument as to form.
