Summary
Section 4.03 of City's Charter specifies the following regarding City Attorney:
The city council shall appoint a city attorney, who shall be a competent attorney, duly licensed to practice law in Texas. The city attorney shall serve at the will of the council and shall receive compensation as fixed by the council. The city attorney shall be the legal advisor and attorney for the city and all its departments and officers in the conduct of city business and shall represent the city in all litigation; however, the city council may retain special counsel at any time it deems necessary or advisable.
The City Attorney has presented the new fees as attached. Please also find attached the current letter agreement.
This item has been scheduled on the regular meeting agenda to allow for discussion and potential action on the item. The City Council is expected to retire to executive session on the item pursuant to Chapter 551.074 of the Texas Government Code for discussion of personnel matters. Action, if any, will take place in open session.
Prior City Council Action
The City Council designated Charles Zech as City Attorney by resolution on August 5, 2017 by Resolution No. 1571-17-08-05-6040. Please find the resolution attached.
Deadline for City Council Action
Action is requested on September 25, 2018. New rates would go into effect on October 1, 2018.
Fiscal Impact
The FY19 proposed budget for the Legal Services department in the General Fund is at the same amount as FY18 - a total of $435,000.
