Approving the partial abandonment and release of existing 20' public landscaping easements on the property located on the northeast corner of the Kingston Lacy Boulevard and Heatherwilde intersection, and authorizing the City Manager to execute the agreement.
Summary
A multi-phase retail development project is proposed at the northeast corner of the Kingston Lacy Boulevard and Heatherwilde intersection. The project is known as the Kingston Lacy Commercial Development and has requested partial abandonment and release of the public landscape easements (doc#2002142648 and doc#2003136279) that exist across the subject property along the north side of Kingston Lacy. The proposed site plan for this property incorporates a driveway in this location. Approving and executing this agreement will vacate the portion of the above mentioned easements that exist on the subject property. The City has previously partially abandoned portions of the above mentioned easements that existed along the South side of Kingston Lacy (doc# 2016029810). These actions have the concurrence of the Highland Park North HOA. The HOA also has a landscape easement in this area and is working with the developer to partially vacate. The HOA will be maintaining a private easement in the southwest corner of the property for the HOA signage and the property owner will become responsible for maintenance of all trees and landscaping on the property.
