Title

Approving a Wastewater Facilities Cost Sharing, Allocation/Reservation and Escrow Agreement for the Vine Creek Subdivision development located northwest of the intersection of Cele Road and Melber Lane and authorizing the City Manager to execute the agreement.

 

Summary

This agreement between Midtex Partners, LTD, Rowe Lane Development, LTD, Independence Title Company, and the City of Pflugerville outlines how wastewater improvements (Lift Station and Force Main) will be designed and constructed by the developers to serve the developer owned tracts (Midtex Partners, LTD and Rowe Lane Development, LTD) and specifies how improvement costs will be shared between the developers (Midtex Partners, LTD and Rowe Lane Development, LTD).  The City will incur no costs in this agreement.  The City is only a party to this agreement in order to agree to evaluate the design, plans and specs and inspect construction of the improvements and approve the same per City’s regulations as done with all other construction submittals using the City’s standard review and inspection processes and to reserve (as allocated within the agreement) the wastewater capacity (1200 LUEs, (Midtex Partners, LTD with 505 LUES and Rowe Lane Development, LTD with 695 LUES) in the improvements for the benefit of the developers (Midtex Partners, LTD and Rowe Lane Development, LTD).

*Living Unit Equivalent (LUE) is defined as the typical flow that would be produced by a small single family residence and is assumed to represent three (3) people living in a residence.
