Discuss policies related to dockless vehicles programs associated with bicycles and motorized scooters.

 

Summary

Cities in central Texas and throughout the state are being confronted with the deployment of dockless vehicle programs associated with bicycles and motorized scooters. Currently, Pflugerville has no local laws or policies in place to properly address this emerging mode of transportation in the region that is expanding to suburban markets beyond Austin.

 

Recently, motorized scooters have been observed in Pflugerville rights of way. While use of the right of way for this purpose is not specifically prohibited, it is not provided for with the appropriate policies to ensure the safe operation of these modes of transportation for the user and others.

 

Fredericksburg recently passed an ordinance prohibiting scooters, and New Braunfels issued a 90-day moratorium. Larger cities such as Austin, San Antonio and Dallas have been challenged by these programs and have passed ordinances to address them accordingly.

 

Transportation for America, according to their website, "is an alliance of elected, business and civic leaders from communities across the country, united to ensure that states and the federal government step up to invest in smart, homegrown, locally-driven transportation solutions." Pflugerville is not a member of this organization. Transportation for America has developed a "playbook for shared micromobility to assist cities develop appropriate general provisions to govern the deployment allowing these services and vehicles to operate.

 

With the Texas Legislature convening in the 86th Session, Senate Bill 549 has been introduced relating to the operation of motor-assisted scooters. As currently drafted, a person operating the motor-assisted scooter must be at least years of age and hold a valid driver's license. The bill also provides additional amendments to the Texas Transportation Code governing the operating conditions, and allowing for the operation on roadways or bicycle paths.

Recommended Action
