Discuss and consider approving revised development review schedules as a result of HB 3167.

Summary
As a result of recent state legislation, HB 3167 requires development review applications to follow a revised review schedule. Effective September 1, 2019, all new subdivision applications will be accepted on specified application dates in order to be considered by the Planning and Zoning Commission within 30 days of a complete application. If a complete application does not meet the Unified Development Code requirements, the application will be placed on the consent agenda for statutory disapproval with the deficient items identified. The new process differs from the current review process by removing an opportunity for an applicant to waive consideration of a subdivision application by the Planning and Zoning Commission until the application meets the minimum requirements.

If an application does not meet the Unified Development Code requirements and is required to be statutorily denied by the Planning and Zoning Commission, an applicant may adjust the plans and follow up with a response submittal identifying how the application has been revised and compliance achieved with the deficient items. Response submittals will only be received on specified dates in order for the Planning and Zoning Commission to consider a response submittal within 15 days of receiving the response. The process may repeat with response submittals until the subdivision application meets the Unified Development Code requirements and can be approved by the Planning and Zoning Commission.

Review of administratively approvable subdivisions (ex. amended plats) and site development applications was also impacted by the recent legislation. Applications will continue to be reviewed administratively and as such, may continue to be submitted on Mondays by noon (with exception to holidays).
