Summary
The City Attorney has recommended the approval of this ordinance to allow for the deletion of Section 154.110 Political and Campaign Signs from the Code of Ordinances. Section 154.110 was reviewed to be either redundant of other sections of the Code of Ordinances or in conflict with federal law.

However, Section 154.103 provides for sign types that are exempt from regulation and is unaffected by this amendment, in which Subsection "B" applies to signs located on “private real property” as defined and limited by Texas Local Government Code §216.903(a) containing primarily a political message not exceeding an effective area greater than 36 square feet, nor more than eight (8) feet high, which are not illuminated and have no moving parts or elements, but specifically excluding a sign, including a billboard, that contains primarily a political message on a temporary basis and that is generally available for rent or purchase to carry commercial advertising or other messages that are not primarily political.

This ordinance was approved on first reading on August 27, 2019.
