Title
Authorizing the City Manager to execute Supplemental Agreement #5 with Freese and Nichols, Inc. in the amount of $1,309,800.00 for professional engineering services associated with the Central Wastewater Treatment Plant expansion construction and post construction phase services for the project.

Summary
This Supplemental Agreement is for construction and post construction phase engineering services by Freese and Nichols, Inc. (FNI) the Engineer of Record for the Central Wastewater Treatment Plant expansion. FNI as the design engineer has a critical role throughout the construction of the project and during the initial period of operation after construction is complete. FNI will review all technical information submitted by the construction Contractor to verify the process equipment and materials to be supplied by the Contractor for the project meet the standards and operational requirements specified by FNI in the contract documents. As the design engineer, FNI interprets the plans and specifications and answers questions from the Contractor or Construction Manager, provides technical review of any proposed changes, and helps resolve unforeseen conflicts during construction to insure that any changes are consistent with the design intent. FNI’s design team members attend construction meetings and provide general engineering observation of the construction in addition to the day-to-day observation by the Construction Manager. As designer of the treatment process, FNI establishes the parameters and operating conditions for initial start-up of the various treatment unit processes, and coordinates with the Construction Manager and Contractor to develop start-up procedures. As design engineer, FNI supports the Construction Manager in establishing commissioning procedures for individual equipment items and unit processes in such a way that the treatment facility remains in compliance with the discharge permit.
