Approving an ordinance on second reading with a caption reading: An Ordinance of the City of Pflugerville, Texas, amending Ordinance No. 1203-15-02-24 of the City of Pflugerville, Texas, as amended, by approving a specific use permit for a proposed bar/tavern on an approximate 1-acre tract of land zoned General Business 1 district (GB1) and Downtown District Overlay (DD) located generally northeast of the N. Railroad Ave. and E. Pecan St. intersection, locally addressed as 200 E. Pecan St, unit 5 to be known as the three legged goat expansion specific use permit (sup1909-01); providing a cumulative and repealer clause; providing for a severability clause; and providing an effective date.

 

Summary

The Three Legged Goat is requesting to incrementally expand the established wine bar at 200 E. Main St. Unit 5, to approximately 400 square feet of neighboring Unit 6 with greater flexibility to expand in the future.  In addition to expanding into the neighboring unit, the applicant intends to expand the existing patio area in front of the unit to wrap around to the rear. This expansion is the impetus for the new SUP request.

 

The wine bar is located in the northern portion of the building that contains the El Rincon restaurant. The proposed expansion will continue to serve Texas wines and beer for on-premise consumption and wine by the bottle. Partnerships have been and will continue to be established for food sales and consumption, but no preparation of food will occur, at this time. The hours of operation are not anticipated to change.  The business will continue to operate within the parameters set forth by the TABC license requirements.

 

The use is permitted by right in the General Business 1(GB1) district but requires a Specific Use Permit to locate in the Downtown District Overlay (DDO). The expansion will require additional parking and site lighting for the pedestrian areas per the DDO standards. The SUP is compatible with the surrounding land uses and in line with the Downtown Action Plan.

 

On November 4th, the Planning and Zoning Commission held a public hearing to discuss the proposal. The SUP request passed with a condition that the permit is limited to Units 5, 6, & 7 and the adjacent outdoor space.

 

Staff Recommendation

Staff recommends approval.

 

City Attorney has approved the ordinance as to form.

 

Planning and Zoning Commission Action

On November 4, 2019 the Planning and Zoning Commission conducted a public hearing and recommended approval with one condition of the proposed ordinance with a vote of 6-0.

 

Prior City Council Action

On November 26, 2019, the City Council held a public hearing and approved the ordinance on first reading with a vote of 6-0.

The second reading of the ordinance is scheduled for December 10, 2019.
