Title

Approving an ordinance on second reading with the caption reading: An ordinance of the City of Pflugerville, Texas, Granting the abandonment and release of an existing wastewater pipeline easement agreement granted to the City of Pflugerville in document number 2017079207 of the official public records of Travis County, Texas.

 

Summary

Approving the above mentioned ordinance authorizes the City Manager to execute the attached Abandonment and Release of existing wastewater easement agreement 2017079207. This easement was granted by Sorento Holdings 2012, LLC to the City of Pflugerville in 2017. Sorento Holdings 2012 LLC, is submitting a new plat which has a re-aligned wastewater easement dedication that will replace the existing easement of record.

 

Since it is located at a high point of the subdivision, Sorento Phase 4 required a wastewater line be constructed through future Sorento Phases 5 and 6 to reach the wastewater interceptor along Jesse Bohls. Construction of the line was completed in January 2018. The line was designed to follow the standard assignment within the future right-of-way of Sorento Phases 5 and 6, but since Phases 5 and 6 had yet to be platted, separate instrument easements were provided within each phase for the purpose of being able to separately vacate the easements at the time of platting of each phase. Sorento Phase 5 is now constructed and ready to be platted, thus requiring the easement within Phase 5 to be vacated in order to allow the Phase 5 right-of-way to be dedicated. By Travis County requirement, the timing of the plat recordation will coincide with the vacation of the easement, meaning the vacation will be recorded and followed by the plat recordation, thus the line becomes contained within platted right-of-way immediately following the vacation of the easement.
