The City Council discussed potential elections to be held on November 3, 2020 at their regular meeting on June 9, 2020. At that time, a worksession item to discuss ordering a special election for disposition of parkland was planned for the June 23, 2020 worksession.
At the June 9, 2020 regular meeting, Mr. Weiss explained that a property owner in Falcon Pointe is interested in purchasing property behind his home that is in a flood plain and is designed as parkland. Council was in agreement to discuss at the June 23, 2020 worksession. Local Government Code, Title 8, Chapter 253, Section 253.001(b) provides that: Land owned, held, or claimed as a public square or park may not be sold unless the issue of the sale is submitted to the qualified voters of the municipality at an election and is approved by a majority of the votes received at the election; provided, however, this proposition shall not apply to the sale of land or right-of-way for drainage purposes to a district, county, or corporation acting on behalf of a county or district.
