Title

Approving a resolution authorizing the filing of an application for assistance from the Texas Water Development Board (TWDB) Clean Water State Revolving Fund (CWSRF) Loan Program for the Wilbarger Creek Regional Wastewater Treatment Facility and wastewater interceptors and authorizing a designated City representative for purposes of furnishing such information and executing such documents as may be required in connection with the preparation and filing of such application for financial assistance and the rules of the TWDB.  

Summary

This agenda item is presented to inform City Council of the City’s interest in securing funding from the Texas Water Development Board (TWDB) in an effort to gain funding for the project while taking advantage of available Grant funds. The resolution will be included with the application to TWDB to fund projects through the Clean Water State Revolving Fund (CWSRF). The City is looking to submit an application for a Texas Water Development Board (TWDB) grant to fund several critical and large Capital Improvement project as noted in the approved 2019 Wastewater Master Plan. The projects included in the application are the Wilbarger Creek Regional Wastewater Treatment Plant facility, 54” Wilbarger Wastewater Interceptor line project, and the Sorento Wastewater Interceptor Phase 2 project.

 

The City has been coordinating with TWDB staff since May 2020 with the initial process of submitting a Project Information Form (PIF) document. TWDB invited the City of Pflugerville to submit an application to fund the projects through the CWSRF, as this funding program includes equivalency funding utilizing the Design, Bid, Bid delivery method. The Texas Water Development Board administers the CWSRF, authorized by the Clean Water Act. The CWSRF provides low-cost financial assistance for planning, acquisition, design, and construction of wastewater, reuse, and stormwater infrastructure. Eligible applicants for the CWSRF include cities, counties, districts, river authorities, designated management agencies, authorized Indian tribal organizations, and public and private entities proposing nonpoint source or estuary management projects.

 

The City has been preparing an application for planning, acquisition, design, and construction of Wilbarger Creek Regional Wastewater Treatment Facility and wastewater interceptors. The scope of the project is to construct a new Wilbarger Creek Regional Wastewater Treatment Facility located near the intersection of Fuchs Grove Rod on Gregg Lane on land owned by the City of Pflugerville and to construct two new interceptors consisting of a Wilbarger Interceptor and a Sorento Interceptor.

 

The project is currently managed under an Owners Representative contract with CP&Y Inc. A Project Information Form (PIF) was previously prepared by CP&Y and submitted to the TWDB and the City was invited to apply for financial assistance not to exceed $165,667,300.

 

City Engineering and Finance staff, CP&Y, RBC Capital Markets, LLC and McCall Parkhurst & Horton LLP are all working to prepare the application to be submitted to the TWDB no later than August 31, 2020.

 

City staff collaborated and coordinated together with the City's Financial Advisor in preparation for the TWDB CWSRF application.  The Finance Department and Financial Advisor is supportive of this type loan opportunity for the City of Pflugerville and it allows the City the option to still further evaluate other loans for the City to move forward.  The Financial Advisor has been working with the City on this financial application and agrees this funding method is a benefit to the City.  The CWSRF provides a subsidy of 1.3% below market rates.

 

Prior City Council Action

City Council approved a professional services agreement with CP&Y in the amount of $479,944.00 for owner representative services associated with the Wilbarger Creek Wastewater Treatment Facility at the February 11, 2020 meeting.
