Summary
This resolution is for authorization of the City Manager to execute a Vacation, Abandonment and Release of Easement to vacate an existing drainage easement within the Carmen Subdivision and proposed Heatherwilde and Wells Branch Retail Site development property. The existing easement has been used to convey surface stormwater flows since its creation. The proposed project eliminates the need for this drainage easement with the proposed construction of new drainage improvements to pipe this surface flow underground and will be dedicating a new drainage easement to sufficiently cover the proposed drainage pipe improvements. Constructing the proposed pipe improvements and vacating this easement will allow a larger portion of the site to be utilized for site development improvements.
Council approval of this vacation is being requested prior to site development permit issuance. This vacation instrument will be filed with Travis County after construction of the pipe improvements is complete, and the new drainage easement for the piped flow will be filed with Travis County prior to Certificate of Occupancy recommendation for the site construction.
