Summary
This agreement between the City of Pflugerville, Lakeside Municipal Utility District No. 3 (District), and Kansal Estate LLC (property owner/developer) will allow the proposed Blackhawk Plaza Development to be served with retail wastewater service from the City of Pflugerville while utilizing the District’s wastewater system on a pass-through basis. The Blackhawk Plaza property is located within the City of Pflugerville’s wastewater CCN service area; however, there is currently not a City wastewater line extended to the tract. The closest wastewater line available for connection belongs to the District. In accordance with this agreement, the developer will extend a public, City of Pflugerville, wastewater line and connect to the existing District wastewater line stub near the property. Per this agreement, the District will accept 8 wastewater LUEs to pass from the proposed development through the District lines to the City wastewater system to receive retail service from the City.
The District purchases and receives wholesale wastewater service from the City with reservation of 1300 LUEs in the City’s wastewater system per existing Wholesale Agreement (Agreement Regarding Wholesale Wastewater Service dated March 22, 2007). Per this Pass-Through agreement, the proposed 8 LUEs which will be passing through the District lines under this Pass-Through Agreement will not contribute to or effect the 1300 LUEs. The District lines will be used on a pass-through basis only and the property will receive retail service from the City of Pflugerville and pay wastewater impact fees directly to the City.
