Title

Approving action to authorize the City Manager to execute a change order for the West SH-130 Wastewater Interceptor Project to SJ Louis Construction of Texas, a deduction from the contract in the amount of $65,500.00.

 

Summary

The West SH-130 Wastewater Interceptor (W. SH 130 WWI) Project was awarded to SJ Louis Construction of Texas on March 10, 2020. The West SH-130 Wastewater Interceptor (W. SH 130 WWI) Project was awarded to SJ Louis Construction of Texas on March 10, 2020. The West SH-130 Interceptor Project consists of approximately 1,700 linear feet of 30” wastewater line, 5,000 linear feet of 33” wastewater line, 3,000 linear feet of 36” wastewater line, 3,900 linear feet of 42” wastewater line, 1,900 linear feet of up to 70 ft deep 42” diameter tunneled wastewater line with three access shafts. The W. SH 130 WWI is to provide a connection of wastewater to the Central Wastewater Treatment Plant after decommissioning the Pfluger Crossing Lift Station.

 

City staff is recommending a deduct change order for the W. SH 130 WWI so SJ Louis, the general contractor, can demobilize from  the job site.

 

The W. SH 130 WWI project was originally scheduled to be substantially complete on July 7, 2021 and a final completion date of August 6, 2021. SJ Louis, was able to accelerate their work schedule and provide the W. SH 130 WWI 8 months ahead of schedule. Although the wastewater line has been substantially completed the Pfluger Crossing Lift Station cannot be decommissioned until the permanent lift station at the Central Wastewater Treatment plant is complete. The permanent lift station at the Central Wastewater Treatment Plant is being constructed as part of another construction contract and will not be completed until September 2021. Final acceptance for the SH 130 WWI will be granted once revegetation is established and environmental controls are able to be removed.

 

A deduct change order for the work associated with the Pfluger Crossing Lift Station in the amount $65,500 from the contract is in the best interest of the City and the Contractor, otherwise SJ Louis wants to demobilize once the vegetation has been established and close out the project or charge an additional fee of $54,706.06 to remobilize to the site and decommission the Pfluger Crossing Lift Station. As a way to not incur a remobilization fee to the site of $54,706.06, it is City Staff’s recommendation to execute a Change Order removing the Decommissioning of the Pfluger Crossing Lift Station and deduct $65,500 from the contract. City staff will include the scope for decommissioning the Pfluger Crossing Lift Station as a part of the upcoming Highland Park Wastewater Interceptor Project so that it can be competitively bid with the project.

Per the Texas Local Government Code, City staff does not have the authority to administratively approve a change in an amount excess of $50,000 (+/-) the overall contract price.  

 

Prior City Council Action

City Council approved the selection of DCS Engineering, Inc. was selected as the most qualified engineer associated with the West SH 130 Wastewater Interceptor Project at the August 23, 2016 meeting. 

City Council approved a professional services agreement with DCS Engineering in the amount of $1,576,559 for the West SH 130 Wastewater Interceptor Project at the October 25, 2016 meeting.


City Council approved a construction contract for the West SH 130 Interceptor Phase 1 Project to S. J. Louis Construction of Texas, Ltd. in the amount of $12,762,393.94 at the March 10, 2020 meeting.

 

City Council approved a Change Order with S.J. Louis in the amount of $173,343.45 associated with the West SH 130 Wastewater Interceptor Project to complete additional public infrastructure improvements requested by the Project Charm Development at the March 10, 20202 meeting.
