Summary
This item has been included on the agenda for amending the current ordinance to implement new Texas Commission on Environmental Quality (TCEQ) regulations and requirements regarding a Cross Connection Control and Backflow Prevention Program.
This ordinance amendment is aimed to modify the existing ordinance to comply with new TCEQ regulations regarding irrigation systems that are connected to a Public Water System that also employ the use of a On-Site Sewage Facility (OSSF). The new TCEQ regulations classify these types of systems as health hazards to the Public Water System and would need to provide adequate backflow protection in the event of a backflow event.
This ordinance amendment also aims to allow for more efficient enforcement of backflow devices that are classified as health hazards by allowing the City’s Public Water System to get these devices tested by a third-party certified backflow prevention assembly tester if they are severely delinquent and pass-through the incurred costs to ensure that the City’s water supply is safe from any possible health hazards that can enter into the distribution system. The current ordinance only allows for the City to take a delinquent device owner to court if the device has failed it’s required tests or requires repairs. This poses a significant risk to the water system as while the court system has significant delays, the water system could be susceptible to potential contamination of the water supply.
