Summary
As a follow up to the January 26th City Council presentation on the City’s ADA Self-Evaluation & ADA Transition Plan, staff requests the formal adoption of the ADA Transition Plan.
The Americans with Disabilities Act (ADA) of 1990 is a comprehensive civil rights law that prohibits discrimination on the basis of disability in employment, access to state and local government services, places of public accommodation, transportation, and other important areas of American life. The City of Pflugerville is required to perform a self-evaluation of their current programs, policies, and practices relative to the accessibility requirements of the ADA, and develop a Transition Plan to address any structural deficiencies at City facilities required to make City services, programs, and activities readily accessible to and usable by individuals with disabilities. While mandated by the Americans with Disabilities Act, the City is responsible for funding the assessments and the resulting Transition Plan.
Title II of the ADA applies to state and local government entities and requires the City to operate each service, program, or activity so that the service, program, or activity, when viewed in its entirety, is readily accessible to and useable by individuals with disabilities.
The City, in making alterations to existing buildings, shall meet the ADA requirements for new design and construction, including compliance with the applicable accessibility standards:
1. For new construction and alterations, the City must adhere to the 2010 Americans with Disabilities Act (ADA) Standards for Accessible Design, as published in the Federal Register on September 15, 2010; and
2. For new construction and alterations of sidewalks and streets, crosswalks, curb ramps, pedestrian signals, on-street parking, shared use paths, and other components of public rights-of-way, the City may adhere to the Proposed Accessibility Guidelines for Pedestrian Facilities in the Public Right-of-Way, published by the Architectural and Transportation Compliance Board (Access Board) on July 26, 2011, 36 CFR Part 1190 or its final adopted guidelines, as ruled by the Texas Department of Licensing and Regulation (TDLR).
The formal adoption of this Resolution approving the City of Pflugerville ADA Self-Evaluation and Transition Plan will reinforce the City of Pflugerville’s commitment to meeting the requirements of the Americans with Disabilities Act (ADA).
Prior City Council Action
City Council approved a professional services agreement with Kimley-Horn and Associates in the amount of $149,997.50 for professional services associated with the Comprehensive Americans with Disabilities Act (ADA) Self Evaluation and Transition Plan at the April 28, 2020 meeting.
