Title
Discuss and consider action to approve a resolution approving a Utility Reimbursement and Joint Access and Use agreement with Manville Water Supply Corporation associated with the relocation of a water line along Kelly Lane in conflict with the Kelly Lane Phase 2 Roadway project.

Summary
This Agenda Item is presented as part of the Kelly Lane Phase 2 Right-of-Way (ROW) and utility coordination. As part of the Kelly Lane Phase 2 roadway project, the existing Manville Water Supply Corporation (MWSC) infrastructure was noted in the Utility Matrix as needs to be moved to avoid conflicts with the project. The City of Pflugerville coordinated with MWSC during the design development of Kelly Lane Phase 2 and determined the Manville waterline required to be relocated outside of the existing ROW, within the area north of the roadway between the Golf Course and up to Moorlynch Avenue. Manville utility design was coordinated with the ROW/Public Utility Easement acquisitions along the Golf Course and the Parcels 7 and 8, which recently were closed August 2021. Manville proceeded with completed design and bid their construction plans to obtain a General Contractor to relocate water line utility once the City completed acquisitions.

MWSC Board approved selection of General Contractor Nelson Lewis for water line in June 2021 and the attached agreement provided for reference. The City has negotiated with MWSC for relocation of their facilities in ROW and the PUE as outlined in the attached Joint Use Agreement as eligible for reimbursement by the City.

Joint Use The agreement specifies the requirements of the City and MWSC respective to relocating the water line. The water line is in a City of Pflugerville easement. The City will be responsible for the total cost for relocating the line.
