On March 30, 2017 the City of Pflugerville approved and executed a Professional Services Agreement PSA with Freese and Nichols, Inc. (FNI) for engineering services for the initial planning study for the Central Wastewater Treatment Plant (CWWTP) Expansion project. Subsequent Professional Service Agreement Amendments (PSSA) covered design services and construction phase services for Phase I of the Expansion, and design services for Phase II of the Expansion, including adjustments to the scope of work as the design progressed. The agreement presented covers additional Construction Phase Engineering Services for the Phase I construction due to the delay of the construction completion date.
Phase I construction began October 19, 2019. FNI’s scope of services for the Construction Phase was authorized based on an anticipated construction duration of 24 months, with Substantial Completion scheduled for October 12, 2021. Construction Contract Change Orders extended the construction contract to a revised Substantial Completion date of April 2022. FNI agreed to provided construction phase engineering services through the revised April 2022 completion date without additional compensation. The most recent construction schedule provided by the contractor revised the Substantial Completion date to February 2023. The Basic Services included in this PSSA extend FNI’s construction phase services for an additional 10 months to cover effort from April 2022 to the projected final completion in February 2023. Should the construction contract extend beyond February 2023, a monthly fee for FNI’s construction phase services is included as a Special Service to be used upon written authorization from the City. The services included in this construction phase services extension are the recurring monthly activities of FNI and Gupta and Associates, Inc. (GAI) described below and do not include scope items already included in previous PSSAs.

Additional Services - Phase II Engineering Design Services
As part of PSSA 08 for the Central WWTP Expansion executed on September 29th, 2021, a reduction of in the Scope of Services credited the project in the amount of $20,302.00 which was set aside as Project Contingency. This PSSA appropriates the Project Contingency to cover the additional Phase II design effort to design a back-up post aeration system to be constructed as part of the Central WWTP Expansion Phase II. The City’s project team requested FNI to include the design of a back-up post aeration system in the new Effluent Pump Station. This work was not anticipated in the original project but has been completed by FNI as part of the 100% deliverable to the City on 7/1/22. The work entailed the design of two new positive displacement (PD) blowers, air piping and supports, retrievable diffuser system, and a fiberglass building to house the blowers in addition to the associated electrical, HVAC, architectural, and structural work.

Pflugerville City Council approved Professional Services Supplemental Agreement # 05 modifying the scope to add Construction Phase and Post Construction Engineering Services and increasing by $1,309,800 the amount payable under the Agreement for a total of $5,201,411 at the October 22, 2019 meeting.
City and Consultant executed a Supplemental Agreement # 06 for Professional Services on the January 19, 2021 modifying the scope and increasing by $18,566 the amount payable under the Agreement for a total of $5,219,977.
Pflugerville City Council approved Professional Services Supplemental Agreement # 07 for Professional Services for Design Phase Services for Phase II of the project increasing by $1,528,933 the amount payable under the Agreement for a total of $6,748,910 at the April 27, 2021 meeting.
City and Consultant executed a Supplemental Agreement # 08 for Professional Services on September 29, 2021 modifying the scope and increasing by $0 the amount payable under the Agreement for a total of $6,748,910.
